Important Update for Our Customers – SB39 Passes into Law in California
We wanted to take a moment to inform our customers of a recent development in California regarding the sale of tobacco products. Senate Bill 39, authored by Senator Jerry Hill, has been passed into law and will impact the delivery of tobacco products including vapor in the state.
The new regulations require any seller or distributor of tobacco products, including those sold through the mail, telephone, facsimile transmission, or the internet, to verify the age of the purchaser or recipient and comply with specific provisions before enrolling them as a customer. This includes checking the name, address, and date of birth of the customer against a database of individuals whose age has been verified to be 21 or older, as well as verifying their billing address on the check or credit card used for payment.
In the case of a sale, the seller must also require payment to be made by personal check or credit card, with no cash payment permitted. The seller must also make a confirmation call before shipping the products and deliver the product in a container labeled with the words “Contains Tobacco Products: Signature of Person 21 Years of Age or Older Required for Delivery” as well as obtain the signature of the receiver at delivery.
